These Terms & Conditions ("Terms") govern your access to and use of Photouria. By creating an account or placing an order you agree to be bound by them. If you do not agree, please do not use the service.

Your use of Photouria's website, application and printing service constitutes acceptance of these Terms together with our Privacy Policy.

02 — Eligibility · 18+Eligibility · 18+

You must be at least 18 years old to create a Photouria account and to purchase physical goods. By signing up you confirm that you meet this age requirement and that the information you provide is accurate.

03 — Your accountYour account

You are responsible for keeping your login credentials secure and for all activity that takes place under your account. One person per account; please don't share logins.

04 — How the system works · profilingHow the system works · profiling

Photouria is not a "blind" upload-to-print service. When you upload images, the system is actively analysing them to create private profiles for the people and pets that appear, so that your library, smart albums and book suggestions can be organised automatically. By uploading photos you acknowledge and consent to this organisational processing as a core part of how the product works.

• Profiles are private to your account and never shared with other users.
• You can rename, merge, split or delete any profile at any time.
• You can delete individual photos, or wipe everything, from your in-app Privacy settings.

05 — AI layouts & generative enhancementsAI layouts & generative enhancements

Photouria uses dynamic layout engines with varying panel sizes and aspect ratios so that your original photography is never severely cropped. To make spreads feel cohesive, the system may also apply AI generative fill / outpainting to extend or optimise backgrounds where a layout would otherwise require an aggressive crop.

These generative AI enhancements are provided "as-is". Photouria is not liable for minor visual artifacts, colour shifts or aesthetic discrepancies introduced by generative processing. A full preview of every spread is shown before purchase and it is your responsibility to review it before placing the order.

Colour accuracy: photo books are printed using CMYK inks on physical paper. Colours, brightness, and contrast in the final printed book will differ from what you see on your screen — this is an inherent characteristic of professional print production, not a manufacturing defect. Screens are backlit and display colours in RGB; print uses reflected light and CMYK pigments. We recommend reviewing your layout on a calibrated display where possible, but we cannot guarantee an exact match between your screen preview and the printed result.

06 — Copyright & licenceCopyright & licence

• You retain full copyright in every photo you upload.
• AI-generated content: where Photouria's layout engine applies generative fill or outpainting to extend the background of a photo for layout purposes, the AI-generated pixels form part of the final printed product. You own the final printed book as a physical object. The AI-generated portions of a layout are not independently copyrightable under current law; Photouria makes no copyright claim over them and uses them solely to complete your order.
• You grant Photouria a limited, worldwide, royalty-free licence strictly to store, process, lay out, render previews of, and print your photos for the sole purpose of fulfilling your orders and operating the service for you. The licence terminates when you delete the photo or your account, save for copies that fulfilment partners must retain for the minimum period required to complete an in-flight order.
• You warrant that you own, or have the necessary permission to use, every photo you upload.

07 — Orders, pricing & paymentOrders, pricing & payment

Prices, taxes and shipping options are displayed at checkout. Payments are processed by Stripe; placing an order constitutes an offer which Photouria accepts when we confirm the order by email and begin manufacturing.

Photouria reserves the right to update prices, shipping rates, and product availability at any time. The price applicable to your order is the price displayed at the time you complete checkout.

08 — Custom manufacturing & refundsCustom manufacturing & refunds

Because every Photouria book is custom-manufactured to your specific uploads, layout choices and cover configuration:

Nothing in these Terms limits or excludes any rights you have under the Consumer Guarantees Act 1993 (New Zealand) or any other applicable consumer protection legislation that cannot lawfully be excluded. Where those statutory rights apply, they prevail over any conflicting term below.

• All sales are final. We cannot offer refunds for customer errors, including but not limited to typos, photo selection, layout preferences, chosen finishes or shipping address mistakes confirmed at checkout.
• Defective prints — manufacturing defects, shipping damage, or missing pages — must be reported to support@photouria.com within 14 days of delivery, with clear photos of the defect. Where a manufacturing defect is confirmed, Photouria will reprint or refund the affected item at its discretion.

Delivery estimates: any production or delivery timeframes communicated by Photouria are estimates only and are not guaranteed. We rely on third-party manufacturing (currently Lulu; Gelato was used for order fulfilment prior to July 2026) and shipping networks; Photouria is not liable for delays caused by these partners or by customs, weather, or carrier disruptions.

09 — Acceptable useAcceptable use

You agree not to upload, store or print:

• Content you do not own or do not have permission to use.
• Illegal, hateful, harassing or violent material.
• Sexual content involving minors, or any other content prohibited by law.
• Material that infringes a third party's intellectual property or privacy rights.

10 — IndemnificationIndemnification

You agree to indemnify, defend, and hold harmless Photouria, its founder, contractors, and sub-processors from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) content you upload that infringes a third party's intellectual property, privacy, or other rights; (b) your breach of these Terms; or (c) your violation of any applicable law. This obligation survives termination of your account.

11 — Force majeureForce majeure

Photouria is not liable for any delay or failure to fulfil an order caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, supply chain disruptions, print-partner production outages, shipping carrier failures, or government actions. In such cases we will contact you and, where fulfilment is permanently impossible, provide a full refund.

12 — TerminationTermination

Photouria may suspend or terminate accounts that breach these Terms. You may close your account at any time from the in-app Privacy settings.

Photouria may also close accounts that have been inactive for 24 consecutive months, following the notice process described in our Privacy Policy.

13 — Disclaimer & limitation of liabilityDisclaimer & limitation of liability

The service is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied, to the fullest extent permitted by law. Photouria's aggregate liability arising out of or relating to the service is capped at the total amount you paid Photouria in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded.

14 — Governing lawGoverning law

These Terms are governed by the laws of New Zealand, and any dispute will be subject to the exclusive jurisdiction of the courts of New Zealand.

15 — ChangesChanges

We may update these Terms from time to time. Material changes will be announced on this page and, where appropriate, by email to your account address. Continued use of the service after changes take effect constitutes acceptance.
